1. Privacy Policy

1.1 Data We Collect

MargRakshak Technologies Pvt. Ltd. ("Company," "we," "us") collects the following categories of personal data when you use the MargNetra device and companion application:

• Identity Data: Name, email address, mobile number, PAN/Aadhaar reference (for KYC purposes on wallet operations, if applicable)
• Vehicle Data: Vehicle registration number, make, model, year, OBD-II port telemetry (speed, RPM, engine load, DTC fault codes, fuel system status)
• Location Data: GPS coordinates (NMEA 0183), trip routes, GPS timestamp (NTP-synced)
• Driving Behaviour Data: IMU sensor data (G-force, angular velocity), braking events, acceleration profiles, following distance estimates via optical sensor
• Video Data: Dashcam footage stored locally on device. Clips are uploaded to cloud only on: (a) crash event detection, (b) user-initiated Bounty Report, (c) user-submitted dispute. Continuous footage is never streamed to cloud servers.
• Financial Data: MargCoin wallet balance states (Provisional, Held, Available). Monetary redemption transactions processed via our licensed banking TSP partner.
• Device Data: Device ID (MAC address), firmware version, NTP-synced timestamps

1.2 How We Use Your Data

• To calculate and maintain your Driver Civil Score (300–900)
• To operate the MargCoin reward wallet in accordance with the hold-settle-or-slash flow
• To provide emergency SOS services (auto-call 112, family alert, hospital location)
• To share driving behaviour data with insurers and institutional partners — only with your explicit, per-use-case consent
• To detect and report road surface defects (pothole mapping) to highway authorities
• To improve our AI models for driving safety assessment

1.3 Data Sharing

We do not sell your personal data to any third party. We share data only under the following conditions:

• Insurance partners: Civil Score query data shared only when you explicitly initiate a PHYD discount application
• Government / Highway authorities: Anonymised, aggregated, and de-identified road surface condition data only
• Emergency services: Location, vehicle details, and driver profile shared automatically during a crash SOS event
• Legal proceedings: Merkle-signed dashcam clips disclosed only under valid court order or with your explicit consent
• Banking TSP partner: Minimal financial data necessary to process wallet redemptions

1.4 Your Rights Under DPDP Act 2023

• Right to access your personal data
• Right to correction of inaccurate data
• Right to erasure ("right to be forgotten") — subject to legal retention obligations
• Right to nominate a representative for your data rights
• Right to file a complaint with the Data Protection Board of India

1.5 Data Retention

Trip telemetry data: 2 years from collection date. Crash event clips with Merkle seal: retained for 5 years or until legal proceedings conclude (whichever is longer). Wallet transaction records: 7 years (financial records compliance). Device footage ring buffer on device: overwrites automatically after 72 hours if no event seal.

2. Terms of Use

2.1 Eligibility

You must hold a valid Indian driving licence to use MargNetra for the Drive-to-Earn programme. The device may be used for monitoring purposes (emergency safety, vehicle diagnostics) without an active licence.

2.2 The Reward Programme

By joining the MargCoin reward programme, you explicitly agree to the hold-settle-or-slash wallet mechanism. In particular, you acknowledge that:

• MargCoins held in the Provisional state are not withdrawable until the 24-hour clean-driving settlement window completes
• Violation detection moves coins to Held state with a 15-minute dispute window — not to immediate deduction
• Only after the grace window closes without a successful dispute does a confirmed violation result in removal of Held coins
• Emergency Safety Override events are never penalised
• Anti-gaming rules apply: net displacement below 1.5 km in a rolling 30-minute window = 0 verified km. Daily rewardable cap: 150 km

2.3 Prohibited Uses

• Attempting to spoof GPS, OBD, or IMU data to fraudulently earn MargCoins
• Operating the SOS function for non-emergency purposes
• Using dashcam footage to harass, defame, or threaten any person
• Modifying device firmware in a way that disables safety or compliance features

2.4 Limitation of Liability

MargRakshak Technologies Pvt. Ltd. is not liable for: failure of emergency services to respond following an SOS call; inaccuracies in pothole GPS coordinates affecting NHAI decisions; network or connectivity failures preventing reward coin transmission; or civil score impacts on insurance premiums set independently by insurer partners.

3. PPI Compliance Statement

Pursuant to: RBI Master Directions on Prepaid Payment Instruments (2017, updated 2023)

MargRakshak Technologies operates as a Technology Service Provider (TSP) in the MargCoin reward economy. We do not directly issue, hold, or transfer Prepaid Payment Instruments as defined under the RBI's PPI Master Directions.

All monetary value in the MargCoin system is held in escrow by an RBI-licensed banking partner. MargCoins are a points-based loyalty instrument that are converted to monetary value only upon explicit user redemption, at which point the conversion and transfer are executed by the licensed banking partner.

The hold-settle-or-slash wallet mechanism is designed to ensure that no unilateral deductions from settled available balances occur without prior user notification and dispute resolution — consistent with the spirit of RBI guidelines on fairness and consumer protection in digital payments.

Note: This structure does not constitute legal advice. MargRakshak Technologies will obtain formal legal counsel and regulatory guidance before any commercial launch of the MargCoin wallet system.

• Strictly Necessary: Session cookies for form submissions and modal state. Cannot be disabled.
• Analytics: We may use privacy-respecting analytics (no third-party cookies, no cross-site tracking). You may opt out at any time.
• No Advertising Cookies: We do not use cookies for advertising, retargeting, or third-party tracking.

This website does not use Google Analytics by default. If analytics are ever introduced, this policy will be updated and a consent banner displayed.
